eTherapyfiles Terms of Service

eTherapyfiles, (an EHR system of Providers Care Billing LLC) (“we,” “us,” “our”), provides software and tools for telehealth practices. By accessing or using our platform, applications, or related services (collectively, the “Service”), you (“Client,” “User,” “you”) agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.


Using the Service

You may use the Service only if you can form legally binding contracts under applicable law and are at least 18 years old. You are responsible for your own accounts, login credentials, and any activity under your account. You must provide accurate, complete, and current information.

You may not:

  • Use the Service for unlawful purposes;
  • Attempt to disrupt or reverse-engineer the Service;
  • Misrepresent your identity or affiliation;
  • Collect or store other users’ personal information without consent.

Account Management

You are responsible for keeping your account credentials secure. Notify us immediately of any unauthorized access. We are not liable for losses resulting from someone else using your account.

If you close your account, you may export your data before termination. After account deletion, your data may be permanently removed.


Subscriptions and Payments

Certain features may require a subscription. Subscription terms, fees, and billing cycles will be outlined at the time of purchase. Payments must be made with valid payment methods.

  • Subscription fees may change; we will notify you before changes take effect.
  • Non-payment may result in suspension or termination.
  • Refunds are granted only at our discretion.

Data Ownership and Responsibility

You retain ownership of the data you upload or generate through the Service. By using the Service, you grant us a license to store, display, or process your data as necessary to provide the Service.

You are responsible for ensuring your use of the Service complies with applicable privacy and healthcare laws, including HIPAA.


Content Guidelines

Content you provide must not violate the rights of others or the law. Prohibited content includes, but is not limited to, content that is:

  • Illegal, offensive, or discriminatory;
  • Infringing on intellectual property;
  • Fraudulent or misleading.

We may remove content at our discretion and suspend accounts for violations.

The Service may integrate with third-party tools (e.g., billing processors, insurance clearinghouses). We are not responsible for errors, delays, or issues caused by these third-party services.

We may also provide links to external websites. We do not control these sites and are not liable for their content or practices.


Intellectual Property

All software, designs, and materials created by eTherapyfiles are our property. You may not reproduce, distribute, or use our intellectual property without written consent, except as part of your authorized use of the Service.


Security and Privacy

We implement industry-standard security measures to protect your data. However, no system is completely secure. You are responsible for maintaining your own login security and for complying with privacy regulations when using the Service.

Liability Limitations

To the fullest extent permitted by law, we are not liable for:

Termination

We may suspend or terminate accounts for violations of these Terms, non-payment, or misuse of the Service. You may also terminate your account at any time by discontinuing use and deleting your account.

Provisions regarding liability, intellectual property, and indemnification survive termination.

These Terms are governed by the laws of the state of IL, without regard to conflicts of law principles.


Indemnification

You agree to defend, indemnify, and hold harmless eTherapyfiles and Providers Care Billing LLC, including our affiliates, employees, and licensors, from any claims or damages resulting from:

  • Your use of the Service;
  • Violation of these Terms;
  • Data, content, or instructions you provide.

Changes to Terms

We may update these Terms occasionally. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
